Korea's cloture week is still ahead

On 15 September the United States Senate gave XRP an answer: 49 to 50, cloture on the Clarity Act not invoked. Not one Democrat voted yes, not even the seven who voted for the stablecoin law last year. Korea has not given its answer yet. It is due this autumn, and it will arrive in the same three layers Washington just showed.

The three layers

Washington had a finished text with 126 accepted changes, an ethics chapter on the president that no drafting could resolve, and a motion to reconsider with no date on it. The lesson was not that crypto legislation failed. It was that a bill is not the unit of decision. The person and the moment are.

Seoul has the Digital Asset Basic Act, expected as a member-sponsored bill in the September session of the National Assembly. On top of it sits the argument between the Bank of Korea, which wants won-stablecoin issuers at least 51 percent bank-owned, and the Financial Services Commission, which says that would stifle the market before it exists. That question will be settled at a negotiating table, not on the floor. The day the bill is introduced will be news. The day the negotiation ends is the real date.

The third layer is where Korea differs, and it is the one that matters for XRP: one date that does not move. On 1 January 2027 a 22 percent capital gains tax on crypto takes effect, and the August tax reform contained no further deferral.

What our own data shows

In the three days after the Senate vote, net flow to the 748 exchange wallets we track was +1.2 million, +33.4 million and +16.5 million XRP. Coins moved onto exchanges and stayed there while price fell 9.6 percent and then recovered most of it on a weaker yen. Upbit, the largest XRP retail exchange in the world, showed a pattern we cannot yet explain: more than 40 deposits a day and effectively zero withdrawals, three days in a row. Either a withdrawal wallet is missing from the public label set, which would be our measurement gap, or Korean retail did not take a single large position off the exchange in the week the United States said no. The Upbit won premium sat at minus 0.6 percent on 18 September. Neutral. Korean retail watched.
